Welcome to FenbrookWay. These Terms and Conditions ("Terms") govern your use of the FenbrookWay website (fenbrookway.sbs) and the services offered by FenbrookWay ("we," "our," or "us").
By accessing or using our website, booking a tour, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.
Please read these Terms carefully before making any bookings. These Terms constitute a legally binding agreement between you and FenbrookWay.
In these Terms, the following definitions apply:
To make a Booking, you must complete our booking process and pay the required Deposit or full payment, as applicable. A Contract is formed between you and FenbrookWay when we issue a Confirmation to you.
The person making the Booking (the "Lead Booker") must be at least 18 years old and possess the legal authority to make the Booking on behalf of all persons named in the Booking. The Lead Booker assumes responsibility for ensuring that all members of their party comply with these Terms.
You must provide accurate and complete information when making a Booking. This includes the correct spelling of all travelers' names as they appear on passports, accurate contact information, and any special requirements. You are responsible for any issues, delays, or additional costs arising from inaccurate or incomplete information.
A non-refundable Deposit of 20% of the total tour cost is required at the time of Booking to secure your reservation. For Bookings made within 60 days of the Departure Date, full payment is required at the time of Booking.
The balance of the payment is due no later than 60 days before the Departure Date. If the balance is not paid by the due date, we reserve the right to cancel your Booking and retain your Deposit.
We accept payment by credit card (Visa, MasterCard, American Express), bank transfer, and PayPal. By providing your payment information, you authorize FenbrookWay to charge the applicable fees to your payment method.
For payments by credit card, a processing fee of 2.5% may apply. There are no fees for payments made by bank transfer.
All prices are quoted in British Pounds (GBP) unless otherwise specified. Prices are based on costs, exchange rates, taxes, and surcharges in effect at the time of publication.
We reserve the right to change prices after you have booked in the following circumstances:
We will absorb an amount equivalent to 2% of the price of your travel arrangements. If the price increase exceeds 10% of your total tour cost, you have the right to cancel your Booking and receive a full refund of all monies paid to us, except for any amendment charges.
If you need to cancel your Booking, you must notify us in writing. Cancellation fees will apply as follows:
No refunds will be provided for unused portions of a tour once it has commenced, regardless of the reason for non-participation.
If you wish to make changes to your Booking after Confirmation, we will make reasonable efforts to accommodate your request. However, we cannot guarantee that changes will be possible. The following fees will apply:
Changes of Departure Date or tour type are treated as cancellations and rebookings, and cancellation fees will apply.
If you are unable to travel, you may transfer your Booking to another person who satisfies all the conditions applicable to the tour, subject to the following conditions:
We cannot guarantee that transfers will be possible in all cases, particularly where flights are involved or special permits are required.
We reserve the right to cancel your tour in the following circumstances:
If we cancel your tour (except due to your failure to pay), you will receive a full refund of all monies paid to us. Alternatively, you may choose to accept an alternative tour of comparable standard, if available (we will refund any price difference if the alternative is of lower value).
We are not responsible for any incidental expenses you may have incurred as a result of your Booking, such as visas, vaccinations, or non-refundable flights. We strongly recommend purchasing comprehensive travel insurance to cover such expenses.
It may be necessary for us to make changes to your tour after Booking. Most changes will be minor, and we reserve the right to make them without compensation.
If we make a significant change to your tour (such as a change of Departure Date or a change to a lower standard of accommodation), we will inform you as soon as possible. You will have the option to:
We will not pay compensation if we have to cancel or change your travel arrangements in any way because of Force Majeure.
It is your responsibility to ensure that you have a valid passport, necessary visas, and comply with health requirements for your journey. Your passport should be valid for at least six months beyond the duration of your trip.
While we may provide general information about passport, visa, and health requirements, we cannot be held responsible for any delays, refusals of entry, or additional costs incurred due to your failure to comply with these requirements.
You should consult with the relevant embassies, consulates, and your doctor for the most up-to-date information regarding your destination.
Travel insurance is mandatory for all our tours. Your insurance must cover personal injury, medical expenses, repatriation, emergency evacuation, trip cancellation, loss of luggage, and personal belongings.
You must provide proof of adequate insurance coverage no later than 30 days before the Departure Date. If you fail to provide proof of insurance, we reserve the right to cancel your Booking and apply the cancellation fees set out above.
Some of our tours require a reasonable level of physical fitness and may not be suitable for those with certain medical conditions or disabilities. It is your responsibility to assess the appropriateness of the tour based on the information we provide.
You must inform us at the time of Booking of any medical conditions, disabilities, or special requirements that might affect your ability to participate in the tour. We will make reasonable efforts to accommodate special requirements, but we cannot guarantee that we will be able to do so in all cases.
You agree to comply with all reasonable instructions from our tour leaders and representatives, as well as the laws, regulations, and cultural norms of the countries you visit.
We reserve the right to terminate your participation in a tour if your behavior is disruptive, threatening, abusive, or dangerous to yourself, other travelers, our staff, or third parties. In such cases, no refund will be provided, and you will be responsible for arranging your own transportation home.
We will make reasonable efforts to accommodate special requests, such as dietary requirements or specific room types, but we cannot guarantee that all such requests will be met. Failure to meet special requests will not be a breach of Contract.
We will arrange and perform your travel arrangements with reasonable skill and care. We accept responsibility if the Services we have agreed to provide are not performed or are improperly performed by us or our Suppliers, except in the circumstances described below.
We will not be liable for any injury, illness, death, loss, damage, expense, cost, or other claim of any description if it results from:
Our liability, except in cases involving death, injury, or illness, shall be limited to a maximum of three times the cost of your travel arrangements. This limitation applies per person and per claim.
We are not responsible for the provision of services by transportation companies (airlines, railways, coach companies, etc.) or for any issues arising from their operations, including but not limited to delays, cancellations, schedule changes, overbooking, or the loss, damage, or delay of luggage.
Many of the Services provided on your tour are provided by independent Suppliers. Those Suppliers provide these Services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the Supplier's liability to you.
We are not responsible for any acts or omissions of Suppliers or other third parties, including guides, hotel staff, transportation providers, or other travelers.
We may provide information about excursions or activities that are available in your destination. If you choose to participate in these excursions or activities, they do not form part of your Contract with us, and we are not responsible for their provision or for anything that happens during the course of their provision by the operator.
We will not be liable or pay you compensation if our contractual obligations to you are affected by Force Majeure. Force Majeure includes, but is not limited to, acts of God, war, threat of war, riot, civil strife, terrorist activity, natural or nuclear disaster, adverse weather conditions, epidemics, pandemics, fire, airport closures, and industrial disputes.
If you have a complaint during your tour, you must inform our representative immediately so that they can attempt to resolve the issue. If our representative is not available, you must contact our office using the emergency contact details provided in your travel documents.
If the problem cannot be resolved to your satisfaction during the tour, you should send us a written complaint within 28 days of the end of your tour.
If you wish to make a complaint after your tour has ended, please write to our Customer Service Department at [email protected] or at our address provided below. Please include your booking reference, details of the issue, and any relevant documentation.
We will acknowledge your complaint within 14 days and aim to provide a full response within 28 days. For complex cases requiring detailed investigation, we may need more time and will keep you informed of progress.
If we cannot resolve your complaint to your satisfaction, you may have the right to refer the matter to the Alternative Dispute Resolution (ADR) entity designated by the Association of British Travel Agents (ABTA).
These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms that cannot be resolved through the process described above shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We collect and process your personal information in accordance with our Privacy Policy, which is available on our website. By accepting these Terms, you consent to our processing of your personal information as described in our Privacy Policy.
You acknowledge that we must provide your personal information to Suppliers and other third parties to facilitate your travel arrangements. This may involve transferring your data outside the European Economic Area (EEA) to countries that may not have data protection laws as stringent as those in the EEA.
During your tour, we may take photographs or videos for promotional purposes. By participating in our tours, you consent to us using images in which you appear for promotional materials, including but not limited to our website, social media, brochures, and other marketing materials.
If you prefer not to be photographed or filmed, please inform our tour leader or representative at the beginning of your tour.
All content on our website, including text, graphics, logos, images, audio clips, video, and software, is the property of FenbrookWay or its content suppliers and is protected by international copyright laws.
You may access, browse, and use our website for your personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or content obtained from our website.
Our website may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of these websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.
We make reasonable efforts to ensure that the information on our website is accurate, but we do not guarantee that the information is complete, accurate, or up-to-date. The information is provided "as is" without any warranties, express or implied.
We reserve the right to change the information on our website, including prices, at any time without notice.
We do not guarantee that our website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs, and platform to access our website. You should use your own virus protection software.

These Terms, together with our Privacy Policy and any other written agreement between you and us, constitute the entire agreement between you and FenbrookWay regarding your Booking and use of our website and services.
You may not assign your rights or obligations under these Terms without our prior written consent.
We reserve the right to modify these Terms at any time. The updated Terms will be posted on our website with the "Last Updated" date revised. Your continued use of our website or services after the posting of changes constitutes your acceptance of the revised Terms.
